Terms of Service

1. Acceptance of Terms

By accessing and using Digital Fire Creative's services, including our WordPress maintenance services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Subscription and Billing

• All subscriptions are billed annually in advance
• Prices are in USD and subject to change with 30 days notice
• Subscription fees are non-negotiable
• Failed payments will result in immediate service suspension
• You are responsible for maintaining accurate billing information

3. No Refund Policy

By purchasing our services, you acknowledge and agree that:

• ALL SALES ARE FINAL AND NON-REFUNDABLE
• No refunds will be issued for partial use of services
• No refunds will be provided for unused portions of annual subscriptions
• Cancellation of service does not entitle you to a refund of any previously paid fees

4. Chargeback and Payment Disputes

By using our services, you explicitly agree to the following:

• You will not initiate any credit card chargebacks or payment disputes
• Filing a chargeback or payment dispute constitutes a breach of this agreement
• You agree to contact Digital Fire Creative directly to resolve any billing issues before disputing charges
• In the event of a chargeback or payment dispute:
  • You will be responsible for a $100 administrative fee
  • You will be liable for all costs associated with the dispute
  • Services will be immediately terminated
  • The matter may be referred to collections
  • Legal action may be pursued to recover funds and costs

5. Service Limitations and Disclaimer

• Services are provided "as is" without any warranties
• We do not guarantee uninterrupted or error-free service
• We are not responsible for third-party plugin or theme issues
• We are not liable for any website downtime or data loss
• Maximum liability is limited to the amount paid for services

6. Cancellation

• You may cancel your subscription at any time
• 30 days written notice is required for cancellation
• Cancellation requests must be sent to eric@digitalfirecreative.com
• No refunds will be issued for early cancellation
• Access to services will continue until the end of the paid period

7. Indemnification

You agree to indemnify and hold harmless Digital Fire Creative, its employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

• Your use of our services
• Your violation of these terms
• Your website content
• Any disputes with third parties

8. Force Majeure

Digital Fire Creative is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, strikes, power failures, or internet outages.

9. Governing Law

These terms are governed by the laws of the State of Ohio. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ohio.
